OUR OBLIGATONS

By using the Elisa Ilana Sites and accepting these Terms, you certify that you are 18 years of age or older.

LAWFUL USE OF THE ELISA ILANA SITES. You agree to use the Elisa Ilana Sites only for lawful purposes. You are expressly prohibited from violating or attempting to violate the security of Elisa Ilana's Sites, including, without limitation.

a) accessing data not intended for you or logging onto a server or an account which you are not authorized to access;
b) attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
c) attempting to interfere with service to any other user, host, or network, including, without limitation, via means of submitting a virus to the Elisa Ilana Sites, overloading, "flooding," "spamming," "mailbombing," or "crashing."
d) sending or relaying unsolicited email, including promotions and/or advertising of products or services; or
e) misrepresenting your identity while using the Elisa Ilana Sites or interfering or attempting to interfere with the proper working of the Elisa Ilana Sites.
f) attempting to FRAUD, or Friendly FRAUD, this website to obtain merchandise for free.

Governing Law and Jurisdiction

You agree that the Site is primarily designed to support and market the services of a single physical location in Omaha, Nebraska. The Site is not designed as, and does not function as, a stand-alone service or business. As such, the Site, as an extension of the physical store, is limited in resources and coverage and are not marketing goods outside of a limited area, and therefore You agree that this use of this Site, and any transactions which may take place through this Site, will be governed by the laws of the state in which the physical store is located, Omaha, Nebraska.

Therefore, You agree that all matters relating to the Site itself, Your use of the Site, transactions which may occur on the Site, these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Nebraska without giving effect to any choice or conflict of law provision or rule (whether of the State of Nebraska or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Site shall be instituted exclusively in the federal courts of the District of Nebraska, or the courts of the State of Nebraska, in each case located in the City of Omaha and County of Douglas. You waive any and all objections to the exercise of jurisdiction over You by such courts and to venue in such courts.

Indemnification

You agree to defend, indemnify, and hold harmless the Elisa Ilana, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to Your violation of these Terms of Use or your use of the Site, including, but not limited to, Your User Contributions, any use of the Site's content, services, and products other than as expressly authorized in these Terms of Use, fees incurred while defending Elisa Ilana in alternative venues or jurisdictions, or Your use of any information obtained from the Site.

Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF THE ELISA ILANA AND ITS SUBSIDIARIES AND AFFILIATES, AND THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID TO THE COMPANY FOR THE APPLICABLE PRODUCT OUT OF WHICH LIABILITY AROSE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Violations of system or network security may result in civil and or criminal liability.

Terms of Sale

1. Products and Pricing

All products or services listed on this website are subject to change, including product information, pricing, and availability. Elisa Ilana reserves the right, at any time, to modify, suspend, or discontinue any website feature or the sale of any product with or without notice. You agree that Elisa Ilana will not be liable to you or any third party for any modification or discontinuance of any website feature or product. If a product is listed at an incorrect price or with incorrect information, we have the right to decline or cancel any such orders, whether or not the order has been confirmed.

2. Payment Terms

For each product you order on this website, you agree to pay the price applicable for the product at the time you submit your order, the delivery fees for the delivery service you select, and any applicable taxes.

**In accordance with payment card association rules your credit and debit cards are generally not charged until we ship the item(s) to you or confirm instore availability (at which time you will be charged only for the goods we have actually shipped along with any appropriate taxes or shipping charges). However, we may pre-authorize the amount of your order with your credit or debit card issuer at the time you place your order, which may affect your available credit line. If you order a special order item, you will be charged immediately. Elisa Ilana Sites e-Gift Cards are debited immediately when you place your order.

We will automatically bill your credit card as part of the order shipment process for such amounts, and you hereby authorize us to do so. You will be solely responsible for payment of all taxes, fees, duties, and other governmental charges, and any related penalties and interest, arising from the product purchase not withheld by Elisa Ilana.

3. Orders

Receipt of an order confirmation from us does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline or cancel your order (in whole or part) for any reason. We may require additional verifications or information before accepting your order. Your order is not accepted until it is shipped (or until a portion of it is shipped). You agree that, if we cancel all or part of your order, we will issue a credit to your credit card in the amount of the canceled portion (if your credit card has already been charged for the order).

4. Shipping

Transit times vary depending on the shipping method selected. Shipping estimates are from the day of shipping, not from the day we receive your order.

**The Free shipping option is USPS Ground Advantage, which is not insured and does not carry a guaranteed day of delivery.

By personally selecting these methods, you, the buyer, assume the risk of loss and agree to these terms and conditions.

If the package is lost, damaged or misdelivered there are no refunds or replacements.

Elisa Ilana will not be responsible for delivery delays due to unforeseen circumstances outside our reasonable control, such as delays due to severe weather, natural disasters, or strikes.

Disclaimer: Please note that Elisa Ilana is not responsible for the carrier's delivery schedule and cannot guarantee your item will be received within the estimated delivery timeframe. Sometimes unforeseen delays occur due to mailing volume of shipping carriers, public holidays, peak periods, customs processing delays, inaccurate or incomplete shipment information (such as P.O. Box for receiver address, missing or inaccurate receiver telephone number), or unavailability or refusal of the receiver to accept delivery.

RISK OF LOSS -- The risk of loss and title to items passes to you upon Elisa Ilana's delivery to the carrier. Elisa Ilana may assist you in placing an insurance claim with the carrier if your order has been insured.

5. Tracking Your Order

A shipping confirmation email will be sent to you once the order has been dispatched. You can track your parcel using the tracking number and link provided. We ship through USPS & UPS.

6. Incorrect Shipping Information Disclaimer

Elisa Ilana is not responsible if a package is not deliverable due to the missing, incomplete, or incorrect destination information. Please take great care to enter the correct shipping details when at checkout. If you realize you have made an error, please call the Customer Service line as soon as possible explaining the error and provide the correct information within 24 hours. However, please note that once the package has been shipped, we are unable to change the destination address. If the package can be rerouted, Elisa Ilana reserves the right to charge a re-shipment fee.

7. Delivered but Not Delivered

If the tracking information shows the item has been delivered to your order address but you have not received it, please contact your shipping carrier for more information. We are not responsible for the packages that are delivered but not received.

If we receive your order as a return package due to missing/incomplete/incorrect destination information, no mail receptacle, undeliverable, refused by the addressee, etc. We will attempt to contact you and give you a three-day window to respond. Additional fees will be needed to cover any re-shipping. If we do not hear from you, a store credit minus original shipping fees will be applied to your account.

8. Offers and Promotions

Elisa Ilana may make available special offers and promotions from time to time. Any such offers and promotions will expire on the dates specified in the offer or promotion. Credits, coupons, prizes, or benefits shall specify the terms that apply to their use, redemption, and terms. Credits, coupons, prizes, and benefits may not be combined with any other offers or promotions. We reserve the right at any time, at our discretion and without prior notice, to discontinue any offer or promotion, or to change any offer or promotion terms or conditions, including changing expiration periods or credit values for existing or future credits

Only one promotion can be used per sale. We reserve the right to exclude certain products from the promotions and/or discounts.

9. Returns & Exchanges

Jewelry may be returned within 30 days of purchase with your receipt. Merchandise returned must be in its original condition, with its original packaging and tags. Discontinued, retired, sale, clearance and customized items are NOT ELIGIBLE FOR RETURN. Only Merchandise is refundable; your shipping is not refundable. The cost of the label will be deducted from your return to cover our costs for the original shipment.

Return/Exchange must be shipped back to the seller in the same method they were shipped to you, secure and insured. We are unable to provide an exchange or issue a refund on merchandise that does not make it back to us, as proven by a tracking number.

Gift Cards and Gift Certificates - Treat Elisa Ilana and Pancharmbracelets.com gift cards like cash. Gift cards are not returnable, not redeemable for cash (except where required by law), and may not be applied as payment or credit to any account. Refunds - Refunds are issued in the same tender as the original purchase. If the original purchase was charged to another cardholder's account (as is often the case with a gift), the refund will be issued as a Store Credit.

10. Charging for Orders and Back Orders

11. Privacy Policy

Elisa Ilana will not sell or give your information to any other party. When you place an order, your name, contact information, billing, and shipping information are retained in our system. Your credit card information is not stored for safety reasons. As an extra level of security, we use the latest SSL encryption technology.

12. When ordering and wanting the item sent to a third party

Elisa Ilana will use the information you provide about someone else when placing an order only to ship the product and to confirm delivery. We will not share this information with outside parties except to the extent necessary to complete that order.

13. UPS cannot deliver to P.O. Boxes.

14. According to Pandora's regulations, we are NOT permitted to ship outside the U.S.A.

If a Pandora order is submitted with an international shipping address, the payment will be voided and the order canceled.

15. This website does not accept non-U.S. credit card payments for Pandora Jewelry & Charm.

If an order is submitted for Pandora Jewelry with a non-U.S. credit card, the payment will be voided and the order canceled.

16. Orders paid via PayPal must ship to a "Confirmed Shipping Address"

If PayPal does not deem the shipping address submitted on the order as a "Confirmed Address," we reserve the right to ship the order to the confirmed billing address or void the payment along with canceling the order. This action is intended to protect customers from fraudulent credit card activity and to minimize chargebacks.

17. Transit time does not include order processing time.

All items on ElisaIlana.com have a "Processing Time" and a "Transit Time". Due to current situations such as COVID-19, you may experience delivery delays. We apologize for any inconvenience this may cause. We value our customers greatly and thank you for your patience during this time.

Order Processing, in most cases, will include credit card validation, name/address verification, and fraud protection screening for your security. You may be required to provide additional documentation or information to complete the verification step. Order processing also includes sizing and special ordering if required. Once complete, your order is ready for final inspection and packaging.

18. Cancellation Policy

You must call our Customer Service Department at 402-926-3479 between Monday and Friday, 10 am - 5pm CST. This is the only accepted method of cancelling your order. An email is acceptable backup, but not a primary communication, and will not constitute a cancellation of your order.

19. Pandora Warranty

All Pandora Jewelry products are covered by a manufacturer's limited 1-year warranty, covering only manufacturer's defects.

20. AUTHORIZED PANDORA RETAILER

We have been an authorized Retailer of Pandora since 2003, and we are listed on the approved list, shown here: https://us.pandora.net/en/explore-the-brand/authorized-retailers.html. When you order from our site, you are ordering from an Authorized online Retailer of Pandora Products.

Warranty Coverage

Pandora warrants all products against defects in materials and workmanship under ordinary consumer use for a period of ONE (1) YEAR from the date of original retail purchase. During these warranty periods, if a defect arises in the product, and you follow the instructions for returning the product, Pandora will, at its option, to the extent permitted by law, either (i) repair the product using new or refurbished parts, at Pandora's expense; (ii) replace the product with a new product that is equivalent to the product that is to be replaced; or (iii) refund to you all or part of the purchase price of the product. Pandora shall have no obligation to repair, replace, or refund until the defective product is returned to Pandora. A replacement product assumes the remaining warranty of the original product or ninety (90) days from the date of replacement or repair, whichever period is longer.

This Limited Warranty applies only to products manufactured by Pandora. This Limited Warranty does not apply to damage caused by accident, abuse, misuse, misapplication, or use of non-Pandora products. Stretching of Pandora chains and bracelets is not considered a manufacturing defect. Wearing counterfeit or non-Pandora charms can damage Pandora bracelets and will void the warranty. Pandora will not replace, fix, or repair a product that has been used with non-Pandora products.

General wear and tear, misuse, exposure to chemicals, and tarnishing are not covered under the warranty.

EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS "LIMITATIONS OF LIABILITY" SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
